1. Acceptance of Terms

By downloading, installing, or using the PopAir application, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our application.

We may update these Terms of Use from time to time. Your continued use of PopAir after any changes indicates your acceptance of the updated terms.

2. License and Use

PopAir grants you a limited, non - exclusive, non - transferable license to download, install, and use the application for your personal or business use on macOS devices that you own or control.

You agree not to:

• Copy, modify, distribute, sell, or lease any part of our application
• Reverse engineer or attempt to extract the source code of the application
• Use the application for any illegal purpose or to generate harmful content
• Use the application to infringe on the intellectual property rights of others
• Abuse the credit system or attempt to circumvent usage limits
• Use automated tools to consume credits or exploit the service

3. Application Features

PopAir is an all - in - one AI assistant for macOS that provides AI Chat with access to multiple frontier models (Claude, GPT, Gemini, Grok, DeepSeek), AI Image Studio for generation, editing, background removal, upscaling, and retouching, plus productivity tools including translation, OCR, text rewriting, summarization, web search, and document analysis.

We continuously add new AI models and features. We may also modify, limit, or discontinue features at our discretion.

4. Credit System

PopAir uses a credit - based system for AI operations. Chat Credits are used for AI chat interactions with different model tiers (Eco, Balanced, Smart) consuming different amounts per message. Power Credits are used for image generation, editing, and other compute - intensive operations.

Credits are allocated monthly based on your subscription plan and do not roll over to the next month. Credit costs for each model are displayed in the app before use.

5. Subscription Plans and Payments

PopAir offers Free, Basic, Pro, and Max subscription plans. Each plan includes different monthly credit allocations and access to different AI model tiers.

Free plan users receive limited credits monthly with access to Eco and Balanced tier models. Paid plans unlock Smart tier models and provide higher credit allocations.

We reserve the right to modify pricing, credit allocations, or available models at any time.

6. Billing and Renewal

Subscriptions renew automatically unless canceled. You are responsible for canceling your subscription before the renewal date to avoid being charged for the next billing cycle.

Credits reset at the beginning of each billing cycle. Unused credits do not carry over. If we are unable to process a payment, we may suspend your access to paid features until payment is successfully processed.

7. Refunds

If you have barely used your credits and the service is not meeting your expectations, you may request a refund within 7 days of purchase by contacting support@popairapp.com. Refund requests are evaluated on a case - by - case basis.

8. AI - Generated Content

You are solely responsible for how you use AI - generated content from PopAir, including chat responses, generated images, and edited images.

You agree not to use PopAir to generate content that is illegal, harmful, defamatory, or infringes on others' rights. AI outputs may not always be accurate. You should verify important information independently.

9. User Content and Privacy

PopAir encrypts your chat messages with AES - 256 - GCM encryption. We do not store your AI inputs on our servers. All AI interactions are processed in real - time.

Your local chat history is stored on your Mac with encrypted storage. You are responsible for ensuring that any content you process through PopAir complies with applicable laws and policies.

10. Third - Party AI Services

PopAir integrates with multiple third - party AI providers including OpenAI, Anthropic, Google, xAI, DeepSeek for chat features, and providers like fal.ai for image generation.

These providers may have their own terms and usage policies. By using PopAir, you acknowledge that your interactions are also subject to the terms of these third - party providers. We are not responsible for the availability, accuracy, or policies of third - party AI services.

11. Intellectual Property

PopAir, its logo, and all related trademarks, trade names, service marks, and logos are the property of PopAir. All content, features, and functionality are protected under applicable intellectual property laws.

You retain ownership of content you create using PopAir, subject to any third - party AI provider terms regarding generated content.

12. Updates and Maintenance

We may release updates to add features, improve functionality, fix bugs, or address security issues. We recommend keeping PopAir updated for the best experience.

We may perform maintenance that temporarily affects service availability. We are not liable for any interruptions during maintenance.

13. Termination

We may terminate or suspend your access to PopAir immediately, without prior notice, if you breach these Terms of Use, abuse the credit system, or engage in prohibited activities.

Upon termination, your right to use PopAir ceases immediately. Any unused credits are forfeited.

14. Limitation of Liability

PopAir is provided "as is" without warranties of any kind. We do not guarantee that AI outputs will be accurate, complete, or suitable for any particular purpose.

We are not liable for any damages arising from your use of PopAir, including but not limited to reliance on AI - generated content.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law provisions.
